Terms of Hire
The standard terms on which we hire out plant. Read them before the machine arrives, not after.
1. Definitions
“We”, “us” and “our” means Ngwana Mmu Group (Pty) Ltd. “You” means the hirer named in the quote or hire agreement. “Equipment” means the plant, machinery and attachments listed in that agreement.
2. Hire period
The hire period runs from delivery to site until collection, unless agreed otherwise in writing. Minimum hire periods apply and are stated in the quote.
3. Rates and payment
- Rates are stated in the quote and exclude VAT unless stated otherwise
- Transport is quoted separately and stated up front
- New clients pay a deposit or in advance on the first hire
- Account terms are available once a payment history is established
- Interest may be charged on overdue amounts at the rate stated in the agreement
4. Your responsibilities
- Use the equipment only for its designed purpose and within its rated capacity
- On dry hire, supply an operator holding valid competency certification
- Carry out daily pre-use inspections and greasing per the operator handbook
- Provide safe access, secure overnight storage and site induction
- Not move the equipment off the agreed site without our written consent
- Not sublet or part with possession of the equipment
5. Fuel and consumables
On dry hire, fuel and daily consumables are your responsibility. On wet hire, fuel for the agreed operating hours and routine maintenance are included. Equipment is delivered fuelled and must be returned fuelled, failing which refuelling is charged.
6. Breakdown
Mechanical breakdown not caused by misuse is our responsibility. Hire charges are suspended from the time the breakdown is reported until the equipment is operational, and we will supply a replacement where one is available. Breakdown caused by misuse, overloading, operator error or lack of daily maintenance is chargeable to you, and hire charges continue.
7. Damage, loss and insurance
The equipment is covered by our plant all-risk policy. You remain responsible for the policy excess, for damage arising from misuse or operation outside rated capacity, and for third-party liability arising from operation of the equipment on your site. Loss or theft must be reported to us and to the police immediately.
8. Standing time
Standing time caused by site conditions, access, weather or waiting instructions is billed at the standing rate stated in the quote.
9. Termination
Either party may terminate on the notice stated in the agreement. We may terminate immediately and recover the equipment if payment is overdue, if the equipment is being misused, or if it is moved without consent.
10. Governing law
These terms are governed by the laws of the Republic of South Africa.
